Terms of Service

These Terms of Service (“Terms”) govern your use of OurFamilyLineage, operated by OurFamilyLineage (“we,” “us,” or “our”). By creating an account or using our services, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to create an account. By using OurFamilyLineage, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately of any unauthorized access. We recommend enabling two-factor authentication for additional security.

3. Your Content

You retain full ownership of all content you upload, including family tree data, photos, stories, documents, and media (“Your Content”). By uploading Your Content, you grant us a limited license to store, display, and process it solely to provide the service to you and your invited collaborators.

You represent that you have the right to upload Your Content and that it does not violate any third party’s rights. You are responsible for ensuring appropriate consent when adding information about living family members.

4. Acceptable Use

You agree not to:

  • Upload malicious content, malware, or harmful files
  • Use the service for any unlawful purpose
  • Attempt to access other users’ accounts or data
  • Circumvent security measures or rate limits
  • Use automated tools to scrape or bulk-download content
  • Upload content that is defamatory, harassing, or violates others’ privacy

5. Subscriptions & Payments

OurFamilyLineage offers free and paid subscription plans. Paid plans are billed monthly or annually as selected at checkout. Payments are processed by Stripe or PayPal.

  • Prices are displayed in USD and include applicable taxes where required
  • Subscriptions auto-renew unless cancelled before the renewal date
  • You may cancel your subscription at any time from your account settings
  • Refunds are handled on a case-by-case basis — contact us within 14 days of charge
  • Downgrading to a free plan retains your data but may limit access to premium features

6. Data Export & Portability

You can export your family tree data in GEDCOM format at any time. We believe your data belongs to you and will never hold it hostage.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for temporary outages or data loss caused by events beyond our reasonable control.

8. Intellectual Property

The OurFamilyLineage name, logo, and application code are our intellectual property. Your Content remains yours. These Terms do not transfer any IP rights between the parties except as explicitly stated.

9. Account Termination

You may delete your account at any time from your account settings. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be permanently deleted within 30 days (see our Privacy Policy for retention details).

10. Limitation of Liability

To the maximum extent permitted by law, OurFamilyLineage’s liability is limited to the amount you paid for the service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which OurFamilyLineage operates. Any disputes will be resolved through good-faith negotiation first, then binding arbitration if necessary.
